Terms of service

These terms apply to your use of the My Geocode API at api.mygeocode.com, the drop-in compatibility hosts on other mygeocode.com subdomains (such as gapi.mygeocode.com), the JavaScript loaders, the dashboard and this website (together, the service). By creating an account or sending a request to the service you agree to them. If you are using the service on behalf of a company, you confirm you can bind that company.

1. The service

My Geocode provides lookups over HTTP: forward and reverse geocoding, address autocomplete, IPv4 and IPv6 geolocation, timezone, elevation and postal code lookup, and hosts that answer in the formats of other providers' APIs. We may add, change or retire endpoints. Retirements of a versioned endpoint are announced by email to account holders at least six months in advance.

2. Accounts and keys

You can use the service without an account or an API key, within the free allowance for requests without a key: 2,500 per UTC day per address, or per website for calls made by scripts on a web page. Keys, prepaid credit and Unlimited packages require an account. Creating an account requires your name, an email address and a password and nothing else. Every account includes 2,500 free requests per UTC day, shared by all of its keys and counted across all endpoints and hosts. You are responsible for all usage under your keys until you revoke them. Server keys must not be published in client-side code or public repositories. Browser keys are made for web pages and work only from the one website they are set up for; you remain responsible for their usage too. If you learn that a key has been exposed, revoke it.

A pay-as-you-go key may be used from at most two IP addresses, and an Unlimited key from at most three, in any rolling 24-hour period per address; requests from further addresses are refused. You may create additional keys and order additional packages for additional addresses.

3. Prices and payment

Prices are shown on the pricing page and are in euros. Above the account's free allowance:

• Credit: each further request costs €0.0001, taken from a prepaid balance that is shared by your pay-as-you-go keys. Credit is bought in advance in packs of €10, €25, €50 or €100, by card or in cryptocurrency, and does not expire. When the balance is empty, requests above the free allowance are refused until it is topped up; nothing is charged automatically.
• Unlimited package: €50 per month, or €500 per year, paid in advance by card or in cryptocurrency, provides one key with no per-request charges. A monthly period runs one calendar month, to the same day of the next month (or that month's last day when it is shorter); a yearly period runs to the same day of the next year. A renewal invoice is issued before expiry; if it is not paid the package lapses and its key continues as a pay-as-you-go key. Nothing renews automatically unless you choose the card subscription at checkout: it is then charged by Polar on the same day each month (or each year, for a yearly package) at the package price until you stop it in the dashboard, and stopping it keeps the period already paid. No refunds are given for partial periods.

What counts as a request is set out on the pricing page. Requests refused with 4xx status codes and requests that fail with 5xx status codes are not counted. Prices exclude taxes. Cryptocurrency payments are converted at the rate shown at checkout and are final once confirmed on the network. Unused credit bought by card can be refunded on request within 90 days of purchase, minus payment processing fees; credit bought in cryptocurrency is not refundable. We may change prices with 30 days' notice by email; changes do not apply to credit already bought or to a package period already paid.

4. Priority when capacity is short

We aim to serve every request, but when capacity is short, traffic on Unlimited keys and credit-bearing accounts is served first.

4a. Referrals and coupons

Each account has a referral code. When an account created through your code pays an invoice, a percentage of that invoice, as published on the pricing page at the time, is added to your referral balance. Referral earnings are not prepaid credit: they can be converted into credit or paid out in a supported cryptocurrency once they reach the published minimum. Payouts are made by hand to the address you give, at the exchange rate we obtain at the time of sending, and cannot be reversed; we are not responsible for funds sent to an address you entered incorrectly. Referring your own accounts, or accounts you control, earns nothing, and we may withhold or reverse earnings that result from abuse, refunds or chargebacks. Coupon codes are subject to the limits shown when they are issued and may be withdrawn at any time; a coupon applied to a cancelled invoice is released.

5. Acceptable use

You must not:

• attempt to evade the allowances or IP limits, for example by creating multiple accounts for one application or sharing keys between organisations;
• use the service to build or feed a competing geocoding, IP geolocation, timezone or elevation service, or otherwise resell the raw data;
• send traffic designed to degrade the service or to probe it for weaknesses without our written agreement;
• use the IP lookup endpoints to identify, track or profile individuals in breach of applicable law;
• use any result to harass, stalk, threaten or intimidate anyone, to publish where a person lives without their consent, or to locate a person who does not want to be found;
• use results to track, profile or monitor individuals in breach of applicable law;
• use results to build, extend or verify mailing lists, or for unsolicited mail or direct marketing, where the source of the data does not allow it or the law forbids it; Australian addresses may not be used to generate an address or a compilation of addresses for the sending of mail unless each address has been verified as able to receive mail against a source other than our results, as the G-NAF licence requires (see our source attributions);
• misrepresent the service as being provided by another company.

We may throttle, suspend or terminate access that breaches this section, with notice where practical.

6. Results and data

You may store, cache, display and combine the results you receive, in your own products, indefinitely, including on maps from other providers. Attribution is not required. Subject to section 5, results are yours to use. The underlying datasets, the service software, the response formats we author and the website content remain ours or our licensors'.

Parts of our data are derived from OpenStreetMap, which is © OpenStreetMap contributors and available under the Open Database License. Maps drawn by the JavaScript drop-in libraries use OpenStreetMap's tiles by default: keep the attribution they show and follow the OpenStreetMap tile usage policy, or configure another tile server whose terms you accept.

7. Drop-in compatibility hosts

The compatibility hosts accept requests in the formats of, and answer in shapes matching, APIs published by Google, Microsoft, HERE, Mapbox, Geocode.Farm, the OpenStreetMap Foundation and others. Those names and formats belong to their owners. My Geocode is not affiliated with, endorsed by or a reseller of any of them, and the data returned by the compatibility hosts is ours, not theirs. You are responsible for ensuring that your own agreements with those providers do not prohibit you from switching.

8. Availability and changes

We aim for the service to be available continuously and publish status information, but we do not guarantee availability or any particular accuracy of results on self-serve plans. Geocoding is an estimate. Do not use results as the sole basis for decisions where an error could cause injury, loss or legal consequences, such as emergency dispatch, without independent verification.

9. Privacy

Our privacy policy explains what we log and why. In short: request logs including IP addresses are kept for 30 days for enforcing key limits, abuse prevention and debugging, then deleted; daily counts per key are kept for billing.

10. Warranties and liability

The service is provided as is. To the extent the law allows, we exclude all implied warranties, and our total liability to you for any claim arising from the service in any twelve month period is limited to the amount you paid us in that period. We are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law.

11. Termination

You can close your account at any time from the dashboard; outstanding usage is invoiced. We can terminate or suspend accounts that breach these terms, and can withdraw the service as a whole with six months' notice. Sections 6, 7 and 10 survive termination.

12. General

These terms are the whole agreement between you and My Geocode about the service. If part of them is unenforceable, the rest still applies. They are governed by the law of the country in which My Geocode is incorporated, and disputes go to the courts there. We may update these terms; material changes are announced by email to account holders and on this page 30 days before they take effect.
